Terms of Service

1. Acceptance of Terms

By accessing or using Smart Invite (smartinvite.app), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the platform.

2. Eligibility

You must be at least 13 years old to use Smart Invite. By creating an account, you confirm that you meet this requirement and that all information you provide is accurate and complete.

3. Account Responsibilities

You are responsible for maintaining the security of your account. You agree to:

• Keep your login credentials confidential and not share them with others.
• Notify us immediately at support@smartinvite.app if you suspect unauthorized access to your account.
• Not create accounts using automated methods or bots.
• Not impersonate other individuals or organizations.

4. Acceptable Use

You agree not to use Smart Invite to:

• Upload, share, or distribute content that is unlawful, abusive, defamatory, obscene, or that infringes on intellectual property rights.
• Send unsolicited messages (spam) or harass other users.
• Attempt to hack, exploit, or disrupt the platform or its infrastructure.
• Scrape or bulk-download data from the platform using automated tools.
• Use the platform for fraudulent or deceptive activities.
• Upload content containing malware, viruses, or harmful code.

5. Content You Upload

You retain ownership of any content (photos, videos, text, invitations) you upload to Smart Invite. By uploading content, you grant Smart Invite a non-exclusive, royalty-free licence to store, display, and transmit that content solely for the purpose of providing the service to you and your invited guests.

You are solely responsible for ensuring you have the right to upload and share any content you post, including obtaining consent from individuals whose images or personal data may appear in that content.

6. Privacy and Data Protection

Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your personal data. We comply with applicable data protection laws, including Cambodia's Law on Electronic Commerce.

7. Free and Paid Plans

Smart Invite offers free and paid subscription tiers:

• Free plan: Up to 3 invitation cards. No credit card required.
• Starter / Pro / Enterprise plans: Additional features and higher limits as described on the pricing page.

Paid plans are billed in advance. We do not offer refunds for unused portions of a billing period except where required by law.

8. Intellectual Property

Smart Invite and its original content (excluding user-uploaded content), features, and functionality are the property of Smart Invite and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute our platform code or branded assets without prior written permission.

9. Third-Party Integrations

Smart Invite integrates with third-party services (Google, Telegram, Facebook, LinkedIn). Your use of those integrations is also subject to those services' own terms and privacy policies. We are not responsible for third-party service outages or policy changes.

10. Limitation of Liability

Smart Invite is provided "as is." To the fullest extent permitted by law, we disclaim all warranties and shall not be liable for any indirect, incidental, or consequential damages arising from your use of the platform, including loss of data, revenue, or business opportunity.

11. Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms, without prior notice in serious cases (e.g., illegal activity, security threats). You may delete your account at any time from your profile settings.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date above and notify you via email or an in-app notice. Continued use of the platform after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the Kingdom of Cambodia. Any disputes shall be resolved through good-faith negotiation or, if necessary, through the competent courts of Cambodia.
